User Accounts

You are responsible for safeguarding your account credentials and all activities that occur under your account.

You must immediately notify us of any unauthorized use of your account.

Subscriptions & Payments

FitEat offers premium features through auto-renewing subscriptions and one-time purchases.

Free Trials

Promotional free trials are available. Unless you cancel before the trial ends, your account will be automatically charged for the subscription.

Billing

By providing a payment method (credit card, Apple Pay, Google Pay, or M-Pesa), you authorize us or our processors to charge applicable fees including taxes.

M-Pesa

Transactions are processed securely. Ensure sufficient balance before initiating. Processing delays may occasionally occur.

Cancellations & Refunds

Manage or cancel your subscription via account settings or the Apple App Store / Google Play Store. Payments are non-refundable except where required by law.

User Conduct & Content

You agree not to use the Services to:

Violate any applicable law, regulation, or third-party right.
Upload, submit, or transmit any content that is harmful, offensive, illegal, or infringes on intellectual property rights.
Attempt to hack, reverse engineer, or disrupt the operation of the Services.
Use automated scripts or bots to extract data from the Services.

You retain ownership of the data and images you scan or input into FitEat. However, by using the Services, you grant Sungusoft Solutions a worldwide, non-exclusive, royalty-free license to use, process, and store this data to provide and improve the Services.

Intellectual Property

All content, features, and functionality of the Services — including design, text, graphics, AI models, logos, and underlying code — are the exclusive property of Sungusoft Solutions and are protected by copyright, trademark, and other intellectual property laws.

Gemini AI — powers AI food recognition and nutritional analysis within the app.

Supabase

Supabase — provides secure cloud database infrastructure and authentication services.

Firebase

Firebase Analytics & Crashlytics — used for app performance monitoring and error reporting.

Payments

M-Pesa, Apple Pay, Google Pay — third-party payment processors handling subscription and transaction flows.

We are not responsible for the availability, accuracy, or reliability of any third-party services.

Limitation of Liability

To the fullest extent permitted by law, Sungusoft Solutions, its directors, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising out of or in connection with your use or inability to use the Services.

Your continued use of the Services after any updates constitutes acceptance of the revised Terms.

These Terms shall be governed and construed in accordance with the laws of the jurisdiction in which Sungusoft Solutions is registered, without regard to its conflict of law provisions. Any dispute arising from these Terms will be subject to the exclusive jurisdiction of the competent courts in that jurisdiction.
